VividExperienceLimited–TermsofConditions 1.BookingTerms&Paymentsa.Bookingscanonlybeconfirmedonreceiptofthedeposit(of£10perperson) b.If,inthefirstinstance,youwouldprefertomakeatelephoneenquiry,aprovisionalbookingcanbeheldforamaximumof10days. c.Shouldthedepositnotbereceivedwithin10days,thebookingwilautomaticalybereleased. d.DepositpaymentservesasconfirmationthattheseTerms&ConditionshavebeenreadandthatthepartycontractingwithVivid(hereinafter‘you’)andalguestsagreeto abidebythesetermsandconditions. e.Depositsarenon-refundableinanyeventandpaymentsduecanonlybeacceptedfromyou. f.1finalbalancepaymentisrequired8weekspriortotheevent.Bookingsmadelesthan8weekspriorwilrequirefulpaymentwithintheearlierof10daysfrombookingor twoweeksbeforetheevent. g.Non-paymentofthefinalbalancebytheduedatewilrenderthecontractvoid. h.AVATinvoicewilbeisuedwhenpaymenthasbeenreceived.Aproformainvoicemaybeisuedpriortoreceiptofpayment. i.Thetotalamountdueoneachinvoicemustbesetledwithasinglepayment.Multiplepaymentsarenotaccepted.j.Debit/creditcardpayments,banktransferorcheque paymentsarefreeofcharge. k.Vividalows16’sandoverintothevenue.However,guestsmustbe18orovertoatendthe‘alinclusive’evenings. 2.BookingChanges a.Bookingchangesareonlyacceptablewhenreceivedfromyou. b.Placesmayberealocatedshouldapartysizedrop. c.Vividwilendeavourtoaccommodatemenuordetailchangesbutwilnotbeheldresponsibleforfailureofanychangesiftheywerecommunicatedlesthan2weeks beforetheeventdate. d.Vividregretsthatchangestobookings,menuchoicesorwineorderscannotbemadeonthedayoftheevent. 3.RefundsandCancelations a.WholebookingcancelationscanonlybemadebyyouandmustbemadeinwritingtoVividatitsregisteredofficeofUnit8WyclifeIndustrialEstate,Luterworth,Leices- tershireLE174HGorsuchotheraddresthatVividnotifiestoyouinwriting.Cancelationsoverthetelephonecannotbeaccepted. b.Depositsarenon-refundableandnon-transferableandcannotbeusedforanyothergoodsorservicesprovidedbyVivid(includingbutnotlimitedtothebalancepayment ordrinksorders) c.Refundsofthebalancepaymentwilbecalculatedasfolowsi.Refund100%lesdeposit,ifcanceledmorethan56dayspriortoyoureventdatei.Refund75%lesdeposit, ifcanceledmorethan28daysbutlesthan56dayspriortoyoureventdateii.Refund50%lesdeposit,ifcanceledmorethan14daysbutlesthan28dayspriortoyour eventdateiv.Norefund,ifcanceled14daysorlespriortoyoureventdate. d.RefundswilbepaidbyVividassoonasreasonablyposiblewithin21daysafterreceivingrefunddetailsfromyou. e.Refundedmonieswilbereturnedviatheoriginalmethodofpayment. 4.Tickets&TablePlans a.YouwilbenotifiedviaemailwhenticketshavebeensentbyVivid2to3weekspriortotheeventdate. b.Duetoon-goingchangesinconfigurations,tableswilnotbealocateduntilthedayoftheevent. c.Shouldindividualplacesetingsberequired,youwilbeabletoalocatetheseduringthePre-dinnerReception,providedthatthisisagreedinadvancewithamemberofthe Vividstaf. 5.MenuPre-orders a.Thereisasetmenuforthisevent,withavegetarianalternative.Vividwilendeavourtoaccommodateanyspecialdietaryrequirementsifrequestedinadvance,alergen informationisheldonaldishesandisavailableonrequest.Vividmustbenotifiedofanydietaryrequirementsnolaterthan2weeksbeforetheeventtothecontactemail addrespublishedonVivid’swebsiteandinitsbrochurefortheapplicableevent. b.Menuchoicesmustbereceivednolaterthan14dayspriortoyourpartydate. c.Vividwilendeavourtoaccommodatemenuchangesbutwilnotbeheldresponsibleforfailureofanychangesiftheywerecommunicatedlesthan2weeksbeforethe eventdate. d.IfmenuoptionsarenotmadebeforetheeventthestandardChristmasmenuwilbeserved. e.Vividreservestherighttomakechangestotheadvertisedmenuintheeventofshortagesinthesupplyofparticularitemsbutundertakesthatathree-coursemealwilbe served. f.Whereapartybookingisformorethan1table,pleasenotethat,oncetheguestsareseated,thewaitingstafwilcheckatwhichtabletheguest(s)withspecialdietary requirementsaresitinginordertoasistwithservice. 6.Beveragesa.Anypre-orderedbeverages,drinksvouchersordrinkspackagesmustbepaidforinadvance. b.Anydrinksvoucherspurchasedarenon-refundableaftertheevent,cannotbeexchangedforcashontheeveningandareonlyvalidfortheyearasstatedonthedrinks vouchers. c.Nodrinksareincludedintheticketpriceexceptwherestated. d.Pre-ordereddrinkspackagescanonlybepurchasedifoneispurchasedforeachandeveryguestintheparty.Vividregretsitisunabletomakeconcesionsforguestswho donotrequirethedrinkspackageforanyreasonwhatsoever. e.Attheevent,anyqueriesregardingabeverageordermustbemadewithamemberofstafatthetime.Weadvisethatyoutakeyourbeverageinvoicetotheeventasproof ofpurchase.Anyisuesnotraisedduringtheeveningcannotbedealtwithpostevent. f.Guestsmaynot,underanycircumstances,bringtheirowndrinks. g.Vividdonotpermitbeveragestoberemovedfromthevenueunderanycircumstances. 7.Miscelaneous a.PricesshownwithinthebrochureincludeVATattherateof20%andaresubjecttochangeshouldtheVATratechange. b.Vividreservestherighttorefuseadmision,andtoremovefromthefunctionanyperson,whoseconditionintheopinionofthestafatthevenueinterferes,orislikelyto interferewith,theenjoymentofthefunctionbyotherparticipants.Thisincludesnon-compliancewiththedrescodestatedinthebrochure,onourwebsiteandontickets. c.Vividdoesnotacceptanyresponsibilityinrespectofanypersonpreventedfromenteringthefunction,oraskedtoleaveduetotheirconduct. d.Vividwiltakeeverycaretohonourcommitments-butreservestherighttoamendoralteralorpartoftheprogrammeofthepartiesandregretthattheywilnotaccept liabilityforerors,changes,omisionsorcancelations. e.Vividdoesnotacceptanyliability&shalnotbeliablefornon-completionoftheevent,orforanydelaysarisingasaresultsofstrikes,riotsorlockoutsafectingtheowner oftheeventvenueoranythirdpartysupplierstoVividand/ortheevent,adverseweatherconditions,los,damageorcancelationduetofire,flood,oranyothercause beyondVivid’sreasonablecontrol. f.Althoughcarparkingareasarepatroled24hrsadayVividdoesnotacceptresponsibilityforlosordamagetoyourvehiclewhilstonitspremises. g.DatesandtimingsadvertisedaresubjecttolicensingapprovalandasufficientlevelofticketsalesinthesoleopinionofVivid. h.PicturesusedinthisbrochurearefrompasteventsmanagedbyVivid-exactthemesets,costumesandentertainmentvaryfromvenuetovenueandfromyeartoyear. i.ItmustbeappreciatedthatVividisrequiredtobookandpayforlabour,entertainmentandcertainfooditemsinadvance. j.NothinginthesetermslimitsorexcludesVivid’sliabilityfordeathorpersonalinjurycausedbyitsnegligence,fraudorfraudulentmisrepresentation,oranyotherliability whichcannotbelimitedorexcludedbyapplicablelaw. k.Subjecttosub-paragraph(j)above,Vividshalhavenoliabilitytoyou,whetherincontractortortorotherwise,foranylosofprofitorofgoodwil,oranylosordamage whichisindirectorconsequentialorwhichdoesnotariseasadirectresultandnaturalresultofabreachofitscontractwithyouorwhichisnotareasonablyforeseeablecon- sequenceofsuchabreachandVivid’saggregateliabilitytoyou,whetherincontract,tort(includingnegligence),forbreachofstatutoryduty,orotherwise,arisingunderorin connectionwiththeprovisionofitscontractwithyoushalbelimitedtotheamountofthepricepaidbyyoutoVividunderyourcontractwithVividfortherelevantevent. l.ThesetermsandconditionsaregovernedbyEnglishlawandintheunlikelyeventofadispute,thepartiesshalsubmittotheexclusivejurisdictionoftheEnglishcourts.
