b.If,inthefirstinstance,youwouldprefertomakeatelephoneenquiry,aprovisionalbookingcanbeheldforamaximumof10days. c.Shouldthedepositnotbereceivedwithin10days,thebookingwilautomaticalybereleased. d.DepositpaymentservesasconfirmationthattheseTerms&ConditionshavebeenreadandthatthepartycontractingwithVivid(hereinafter‘you’)andalguestsagreetoabideby thesetermsandconditions. e.Depositsarenon-refundableinanyeventandpaymentsduecanonlybeacceptedfromyou. f.1finalbalancepaymentisrequired8weekspriortotheevent.Bookingsmadelesthan8weekspriorwilrequirefulpaymentwithintheearlierof10daysfrombookingortwo weeksbeforetheevent. g.Non-paymentofthefinalbalancebytheduedatewilrenderthecontractvoid. h.AVATinvoicewilbeisuedwhenpaymenthasbeenreceived.Aproformainvoicemaybeisuedpriortoreceiptofpayment. i.Thetotalamountdueoneachinvoicemustbesetledwithasinglepayment.Multiplepaymentsarenotaccepted.j.Debit/creditcardpayments,banktransferorchequepayments arefreeofcharge. k.Vividalows16’sandoverintothevenue.However,guestsmustbe18orovertoatendthe‘alinclusive’evenings. 2.BookingChanges a.Bookingchangesareonlyacceptablewhenreceivedfromyou. b.Placesmayberealocatedshouldapartysizedrop. c.Vividwilendeavourtoaccommodatemenuordetailchangesbutwilnotbeheldresponsibleforfailureofanychangesiftheywerecommunicatedlesthan2weeksbeforethe eventdate. d.Vividregretsthatchangestobookings,menuchoicesorwineorderscannotbemadeonthedayoftheevent. 3.RefundsandCancelations a.WholebookingcancelationscanonlybemadebyyouandmustbemadeinwritingtoVividatitsregisteredofficeofUnit8WyclifeIndustrialEstate,Luterworth,Leicestershire LE174HGorsuchotheraddresthatVividnotifiestoyouinwriting.Cancelationsoverthetelephonecannotbeaccepted. b.Depositsarenon-refundableandnon-transferableandcannotbeusedforanyothergoodsorservicesprovidedbyVivid(includingbutnotlimitedtothebalancepaymentordrinks orders) c.Refundsofthebalancepaymentwilbecalculatedasfolowsi.Refund100%lesdeposit,ifcanceledmorethan56dayspriortoyoureventdatei.Refund75%lesdeposit,ifcanceledmorethan28daysbutlesthan56dayspriortoyoureventdatei.Refund50%lesdeposit,ifcanceledmorethan14daysbutlesthan28dayspriortoyoureventdateiv.No refund,ifcanceled14daysorlespriortoyoureventdate. d.RefundswilbepaidbyVividassoonasreasonablyposiblewithin21daysafterreceivingrefunddetailsfromyou. e.Refundedmonieswilbereturnedviatheoriginalmethodofpayment. f.ShouldwebeforcedtocanceloureventsduetoGovernmentrestrictionssuroundingCovid-19,fulticketrefundswilbeisued.Outsideofthis,ourstandardtermsandconditions apply. 4.Tickets&TablePlans a.YouwilbenotifiedviaemailwhenticketshavebeensentbyVivid2to3weekspriortotheeventdate. b.Duetoon-goingchangesinconfigurations,tableswilnotbealocateduntilthedayoftheevent. c.Shouldindividualplacesetingsberequired,youwilbeabletoalocatetheseduringthePre-dinnerReception,providedthatthisisagreedinadvancewithamemberoftheVivid staf. 5.MenuPre-orders a.Thereisasetmenuforthisevent,withavegetarianalternative.Vividwilendeavourtoaccommodateanyspecialdietaryrequirementsifrequestedinadvance,alergeninformation isheldonaldishesandisavailableonrequest.Vividmustbenotifiedofanydietaryrequirementsnolaterthan2weeksbeforetheeventtothecontactemailaddrespublishedon Vivid’swebsiteandinitsbrochurefortheapplicableevent. b.Menuchoicesmustbereceivednolaterthan14dayspriortoyourpartydate. c.Vividwilendeavourtoaccommodatemenuchangesbutwilnotbeheldresponsibleforfailureofanychangesiftheywerecommunicatedlesthan2weeksbeforetheeventdate. d.IfmenuoptionsarenotmadebeforetheeventthestandardChristmasmenuwilbeserved. e.Vividreservestherighttomakechangestotheadvertisedmenuintheeventofshortagesinthesupplyofparticularitemsbutundertakesthatathree-coursemealwilbeserved. f.Whereapartybookingisformorethan1table,pleasenotethat,oncetheguestsareseated,thewaitingstafwilcheckatwhichtabletheguest(s)withspecialdietaryrequirements aresitinginordertoasistwithservice. 6.Beverages a.Anypre-orderedbeverages,drinksvouchersordrinkspackagesmustbepaidforinadvance. b.Anydrinksvoucherspurchasedarenon-refundableaftertheevent,cannotbeexchangedforcashontheeveningandareonlyvalidfortheyearasstatedonthedrinksvouchers. c.Nodrinksareincludedintheticketpriceexceptwherestated. d.Pre-ordereddrinkspackagescanonlybepurchasedifoneispurchasedforeachandeveryguestintheparty.Vividregretsitisunabletomakeconcesionsforguestswhodonot requirethedrinkspackageforanyreasonwhatsoever. e.Attheevent,anyqueriesregardingabeverageordermustbemadewithamemberofstafatthetime.Weadvisethatyoutakeyourbeverageinvoicetotheeventasproofof purchase.Anyisuesnotraisedduringtheeveningcannotbedealtwithpostevent. f.Guestsmaynot,underanycircumstances,bringtheirowndrinks. g.Vividdonotpermitbeveragestoberemovedfromthevenueunderanycircumstances. 7.Miscelaneous a.PricesshownwithinthebrochureincludeVATattherateof20%andaresubjecttochangeshouldtheVATratechange. b.Vividreservestherighttorefuseadmision,andtoremovefromthefunctionanyperson,whoseconditionintheopinionofthestafatthevenueinterferes,orislikelytointerfere with,theenjoymentofthefunctionbyotherparticipants.Thisincludesnon-compliancewiththedrescodestatedinthebrochure,onourwebsiteandontickets. c.Vividdoesnotacceptanyresponsibilityinrespectofanypersonpreventedfromenteringthefunction,oraskedtoleaveduetotheirconduct. d.Vividwiltakeeverycaretohonourcommitments-butreservestherighttoamendoralteralorpartoftheprogrammeofthepartiesandregretthattheywilnotacceptliability forerors,changes,omisionsorcancelations. e.Vividdoesnotacceptanyliability&shalnotbeliablefornon-completionoftheevent,orforanydelaysarisingasaresultsofstrikes,riotsorlockoutsafectingtheownerofthe eventvenueoranythirdpartysupplierstoVividand/ortheevent,adverseweatherconditions,los,damageorcancelationduetofire,flood,oranyothercausebeyondVivid’sreasonablecontrol. f.Althoughcarparkingareasarepatroled24hrsadayVividdoesnotacceptresponsibilityforlosordamagetoyourvehiclewhilstonitspremises. g.DatesandtimingsadvertisedaresubjecttolicensingapprovalandasufficientlevelofticketsalesinthesoleopinionofVivid. h.PicturesusedinthisbrochurearefrompasteventsmanagedbyVivid-exactthemesets,costumesandentertainmentvaryfromvenuetovenueandfromyeartoyear. i.ItmustbeappreciatedthatVividisrequiredtobookandpayforlabour,entertainmentandcertainfooditemsinadvance. j.NothinginthesetermslimitsorexcludesVivid’sliabilityfordeathorpersonalinjurycausedbyitsnegligence,fraudorfraudulentmisrepresentation,oranyotherliabilitywhich cannotbelimitedorexcludedbyapplicablelaw. k.Subjecttosub-paragraph(j)above,Vividshalhavenoliabilitytoyou,whetherincontractortortorotherwise,foranylosofprofitorofgoodwil,oranylosordamagewhichis indirectorconsequentialorwhichdoesnotariseasadirectresultandnaturalresultofabreachofitscontractwithyouorwhichisnotareasonablyforeseeableconsequenceofsuch abreachandVivid’saggregateliabilitytoyou,whetherincontract,tort(includingnegligence),forbreachofstatutoryduty,orotherwise,arisingunderorinconnectionwiththeprovisionofitscontractwithyoushalbelimitedtotheamountofthepricepaidbyyoutoVividunderyourcontractwithVividfortherelevantevent. l.ThesetermsandconditionsaregovernedbyEnglishlawandintheunlikelyeventofadispute,thepartiesshalsubmittotheexclusivejurisdictionoftheEnglishcourts.
